Terms of Use
The rules for using GluScout.
Introduction
These Terms of Use ("Terms") govern your use of the GluScout application ("App") for macOS, developed by Sebastian Zajec ("Developer," "we," "us," or "our"). By downloading, installing, or using GluScout, you agree to be bound by these Terms.
Medical Disclaimer and Important Warnings
NOT A MEDICAL DEVICE: GluScout is NOT a medical device and is NOT intended for medical diagnosis, treatment, or clinical decision-making. This application is designed solely for informational and educational purposes to help you view glucose data from your own Nightscout servers. It gives no medical advice.
Essential Medical Warnings
- Always verify glucose readings with approved medical devices before making any medical decisions
- Discuss any changes with your care team before you change your treatment
- Do not rely solely on GluScout for critical health decisions or emergency situations
- Seek immediate medical attention for diabetes emergencies regardless of app readings
- GluScout may display inaccurate, delayed, or missing data due to technical limitations
- Screen reader and accessibility features may present data differently than visual displays - always verify accessibility-announced values when possible
- Analytics and Observations describe your data and are not advice. They depend on the readings available, and GMI is an estimate that may differ from a laboratory HbA1c
- Alerts are a convenience, not a safety-critical system. Keep using the alarms of your approved CGM, receiver or pump
Data Accuracy Limitations
- Glucose values displayed depend on the data on your Nightscout server
- Readings older than 15 minutes are dimmed and show their age
- Network connectivity issues may cause delays or missing readings
- Technical failures may result in incorrect or outdated information
- The app cannot guarantee real-time accuracy or continuous monitoring
License and Usage Rights
License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use GluScout on compatible macOS devices that you own or control.
Permitted Uses
You may use GluScout to:
- Connect to your own Nightscout servers, one Profile per server, including servers of people who have agreed to share their data with you
- View the latest glucose reading, trend and age in the menu bar and popover, and a 4-hour chart
- Use the Analytics window to see patterns in your data over a range from one week to one year
- Receive alerts as macOS notifications on your Mac
- Use VoiceOver and other accessibility features
- Use the application in English or Polish
Prohibited Uses
You may NOT:
- Use the app for commercial purposes or redistribute it
- Reverse engineer, decompile, or disassemble the application
- Remove or modify any copyright notices or restrictions
- Use the app in any way that violates applicable laws or regulations
- Share your Nightscout access tokens with unauthorized parties
User Responsibilities
Credentials
- You are responsible for the security of your Nightscout server and your access tokens
- If you think an access token has been exposed, replace it on your Nightscout server
Technical Requirements
- You must maintain a compatible macOS system (14.6 or later)
- You are responsible for maintaining your own Nightscout server
- You need an internet connection that can reach your Nightscout server
Compliance
- You agree to use the app in compliance with all applicable laws
- You are responsible for any data privacy regulations in your jurisdiction
- You must follow the guidance of your care team
Data and Privacy
Data Processing
- GluScout keeps your data on your Mac, including a copy of up to one year of readings for the Analytics window. You can delete it in Settings or by deleting a Profile
- GluScout sends your data only to the Nightscout servers you add
- The Developer does not receive, store or access your glucose data, and GluScout contains no analytics, tracking or cloud services
Privacy Policy
Your privacy is protected under our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our data practices.
Third-Party Services
GluScout connects to your Nightscout servers, which are independently operated. We are not responsible for the security, availability, or data practices of any Nightscout server or hosting service. GluScout is independent and is not affiliated with the Nightscout project.
Limitation of Liability
Maximum Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO GLUSCOUT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION.
Excluded Damages
WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, or goodwill
- Any medical complications, injuries, or health consequences
- Any decisions made based on app data or functionality
- Any interruption of business or personal activities
Medical Decisions
WE EXPRESSLY DISCLAIM ANY LIABILITY FOR MEDICAL DECISIONS MADE BASED ON INFORMATION PROVIDED BY GLUSCOUT. ALL MEDICAL DECISIONS SHOULD BE MADE IN CONSULTATION WITH QUALIFIED HEALTHCARE PROFESSIONALS.

App Functionality
GLUSCOUT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of accuracy, reliability, or timeliness of data
- Warranties of uninterrupted or error-free operation
- Warranties of compatibility with all systems or configurations
Technical Support
While we strive to provide a reliable application, we do not guarantee:
- Continuous availability of the app or its features
- Compatibility with all macOS versions or system configurations
- Resolution of all technical issues or bugs
- Ongoing maintenance or updates
Intellectual Property
Ownership
GluScout and all related materials are owned by the Developer and are protected by copyright, trademark, and other intellectual property laws.
Trademarks
"GluScout" and related marks are trademarks of the Developer. You may not use these trademarks without our express written permission.
Termination
Termination by You
You may terminate your use of GluScout at any time by uninstalling the application from your device.
Termination by Us
We may terminate or suspend your access to GluScout immediately if you breach these Terms or engage in prohibited activities.
Effect of Termination
Upon termination, your license to use GluScout will end, and you must stop using the application and delete all copies from your devices.
Updates and Changes
App Updates
We may release updates to improve functionality, security, or compliance. Updates may modify features or require acceptance of new terms.
Terms Updates
We reserve the right to modify these Terms at any time. Material changes will be communicated through app updates or our website. Continued use after changes constitutes acceptance.
Compliance and Regulatory
Medical Regulations
GluScout has not been evaluated or approved by the FDA, EMA, or other medical regulatory agencies. It is not intended to replace approved medical devices or professional medical advice.
Regional Compliance
Users are responsible for ensuring their use of GluScout complies with local healthcare regulations, data protection laws, and medical device requirements.

Governing Law
These Terms are governed by the laws of Poland, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Poland.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding GluScout and supersede all prior agreements and understandings.
Medical Emergency Procedures
IN CASE OF MEDICAL EMERGENCY:
- DO NOT rely on GluScout for emergency glucose information
- Use approved medical devices to verify glucose levels
- Follow your emergency action plan from your care team
- Contact emergency services immediately if needed
- Contact your care team for urgent medical decisions
By using GluScout, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not download, install, or use the application.
GluScout is developed by Sebastian Zajec. This application is not affiliated with the Nightscout project or with any medical device manufacturer.
